This Privacy Policy and Legal Disclaimer governs the use of the mobile application known as BandBeats, hereinafter referred to as the Application, developed for the iOS and iPadOS platforms. By downloading, installing, accessing, or utilizing the Application, you explicitly acknowledge, understand, and agree to be bound by all the terms, conditions, and legal stipulations set forth within this document. If you do not agree to these terms, you are strictly prohibited from using the Application and must delete it from your device immediately. This agreement constitutes a legally binding contract between you, the end user, and the independent developer of the Application. Regarding user privacy and data security, the Application is engineered from the ground up to operate with a zero-data footprint. The developer does not collect, harvest, record, log, store, transmit, or share any personal information, behavioral analytics, location coordinates, network history, or unique device identifiers. The Application functions entirely locally and autonomously on the user's physical hardware, requiring no active internet connection or external server communication to execute its core utilities. Furthermore, the Application does not integrate any third-party software development kits, advertising networks, tracking pixels, or data-brokering mechanisms, ensuring total compliance with global data protection frameworks, including the Children’s Online Privacy Protection Act and the General Data Protection Regulation. The Application and all associated assets are provided to the end user on an as-is and as-available basis, without any warranties or representations of any kind, whether express, implied, statutory, or otherwise. The developer expressly disclaims all implied warranties, including but not limited to any warranties of merchantability, fitness for a particular purpose, quiet enjoyment, and non-infringement. While the software utilizes high-priority hardware timing protocols, the developer makes no guarantee that the audio engine will remain entirely error-free, completely uninterrupted, or mathematically perfect under severe device central processing unit throttling, low memory states, or unoptimized operating system background activity. To the maximum extent permitted by applicable law, in no event shall the developer, their affiliates, or licensors be held liable for any direct, indirect, incidental, special, exemplary, punitive, or consequential damages whatsoever arising out of or in any way connected to the use, misuse, or inability to use the Application. This comprehensive limitation of liability applies regardless of the legal theory advanced, whether based on contract, tort, strict liability, negligence, or breach of warranty, even if the developer has been previously advised of the possibility or likelihood of such damages occurring. This explicit exclusion of legal liability specifically covers, without limitation, any and all forms of physical injury, repetitive strain injuries, carpal tunnel syndrome, joint degradation, cardiovascular stress, or other adverse medical conditions, up to and including death, resulting from musical practice, intensive technical drills, or extended exposure to extreme rhythmic tempos ranging up to five hundred beats per minute. The user assumes full personal and medical responsibility for monitoring their physical exertion and pacing their practice sessions safely. Furthermore, the developer disclaims all liability for any permanent or temporary auditory impairment, acoustic trauma, hearing loss, or tinnitus resulting from the volume levels of the metronome clicks as reproduced through internal device speakers, external amplifiers, headphones, earphones, or high-fidelity auditory monitoring setups. It remains the sole responsibility of the user to manage their audio equipment and adhere to safe decibel listening thresholds. Additionally, the developer shall not be held liable for any optical strain, visual fatigue, or neurological episodes triggered by high-speed visual animations or flashing interface elements synchronized with the audio output. In terms of property and financial protection, the developer is not responsible for any damage inflicted upon musical instruments, peripheral audio hardware, electronic cables, mobile devices, tablets, or other physical property through the operation or physical handling of the Application. In the event that any jurisdiction does not allow the exclusion or limitation of certain categories of liability, the developer's total cumulative liability to the user for any and all claims, actions, or damages shall strictly not exceed the actual monetary amount paid by the user, if any, to purchase the Application. The developer reserves the right to amend, update, or revise this document at any time without prior individual notification, and continued use of the Application following any such modifications shall automatically constitute your legal acceptance of the revised terms.
