PDF release of Draft Version 5.6 of Operation Checkmate.

Changes since v5.5:

  • §§1.14 – 1.16 (Prosecutorial Duties — Protecting the Presumption of Innocence) — duty to disclose adverse evidence to the jury (codifying and expanding Brady v. Maryland); malicious prosecution as a Class 1 felony (capital where the prosecution causes death); duty to seek reduction or dismissal pre-trial, post-trial, and post-conviction.
  • §§1.17 – 1.20 (Judicial Duties — Maintaining the Integrity of the Court) — affirmative duty of impartiality and recusal; duty to engage on the merits and stop rubber-stamping; prohibition on ex parte communications; duty to apply mandatory rules and correct errors. The robe is not a license. It is a constraint.
  • §14.7 (substantially expanded) — clarifies that where this Act provides Utah citizens greater protection than federal law, it controls within Utah without preemption analysis; improper federal-judicial nullification of this Act is reachable as Anarchy / Reckless Prosecution / Cabalism / Racketeering / Treason. Adds dual-sovereignty SCOTUS precedent (Lanza, Abbate, Bartkus, Heath, Gamble) and abrogates In re Neagle — federal officer status is not a shield from Utah criminal prosecution.
  • §15 (NEW) — Nullity of Repugnant Government Instruments — extends Marbury v. Madison's 'a law repugnant to the Constitution is void' principle to every form of government instrument: warrants, judgments, court orders, policies, practices, memos, regulations, subpoenas, administrative actions. Citizens who refuse to comply with a null instrument are not liable. Issuing/enforcing actors face criminal liability under this title with no immunity.
  • AI_chat.md added — a single bundled prompt for ChatGPT / Claude / Grok / Gemini, allowing any citizen to chat with the bill in plain language and apply it to their situation. Referenced prominently in the README.
