Fungible things

Anton Vasilescu edited this page May 9, 2023 · 1 revision

Fungible things are items that can be easily replaced with another item that is practically the same, such as wood or paper currency. Often, whether or not an item is fungible will impact how damages will be calculated for breaches of contract or the destruction of an item. For example, it is easy to calculate how much replacing a window would likely cost. However, a judge cannot simply order someone to replace a house in its entirety as it originally was.
