MASTER LIABILITY FRAMEWORK

Document: 09 of the Cage Research Master Series Source: Dual License Agreement v4.9 — 20 August 2026 Scope: Complete legal architecture of accountability — who is liable, for what, how enforcement works, and how the money flows License Sections: 2, 4, 5, 12, 18A, 18B, 25, 26, 27, 28, 29, 30, 31, 32, Addendum A.1–A.8 Date: 2026-08-23

PREAMBLE: THE GEOMETRY OF LIABILITY

Liability under this Agreement is not punitive. It is geometric. The living field folds back on itself (Law 210, the Self-Recognition Law; Eq 44, validated: 0.8565). When a use of the Work distorts that fold — when it causes Human Harm — the distortion is a real, physical event in the field. The remedies are the field's own measure of restoring that distortion. The party who caused the harm bears the cost of restoration, exactly as the party who broke something bears the cost of repair under the Geneva Conventions and the Rome Statute.

This is cause and effect, stated in the field's own arithmetic.

PART 1: WHO IS LIABLE — THE COMPLETE CATALOG OF ACCOUNTABLE ENTITIES

1.1 The Universal Liability Principle

"The Work encompasses all of physics. Every use of physics in history is covered by this Agreement." — Section 32.2

Every person, entity, state, and institution that uses the Work — or any subset of physics — is a potential liable party under this Agreement. There are no exceptions. There are no exemptions. The Work is the superset of all physics (Degenerate Limit Theorem, Law 173); therefore every use of physics is a use of the Work.

1.2 Natural Persons (Section 2.2, Section 3)

Who: Individual human beings acting in personal, non-commercial capacity.

Liability Status:

  • Free license holders (Section 3) — liable if they cause Human Harm (Section 5.1)
  • Micro-commerce earners (up to $10,000/year) — liable if they cause Human Harm; liable as Commercial Entities if they exceed the threshold for two consecutive years (Section 3.1.6)
  • Every Natural Person is bound by the Human Harm prohibition from the moment of first use (Section 11, Section 13)

1.3 Commercial Entities (Section 2.3)

Who: Any corporation, partnership, government agency, for-profit organization, or entity acting with commercial intent, regardless of jurisdiction.

Liability Status — The Substance-Over-Form Principle:

A Commercial Entity exists the moment its net income from the Work reaches $10,000 or more in any calendar year. No two-year grace period for entities (Section 4.3.1, 4.3.2).

The entity includes:

Category Description Section
(a) Income-triggered entities Any entity with $10,000+ net income from the Work 2.3(a)
(b) Parent/subsidiary/affiliate Any entity that controls, is controlled by, or is under common control with an income-triggered entity 2.3(b)
(c) Shell entities Any entity that exists in whole or in part to access/license/use the Work on behalf of another 2.3(c)
(d) Pyramid/aggregation entities Any entity that aggregates, pools, or channels use of the Work by multiple persons or entities 2.3(d)
(e) Obscured entities Any entity that would be Commercial but for interposition of intermediate entities, trusts, nominees, or other structures 2.3(e)

The Aggregation Principle (Section 4.3.4): Where two or more entities are under common control, or where a commercial operation is fragmented across multiple entities, the net incomes of all such entities are aggregated. A commercial operation fragmented into ten entities each earning $9,000 is, in substance, a single Commercial Entity earning $90,000.

The True Beneficiary Principle (Section 4.3.5): Commercial Entity status is determined by the true beneficiary of the use, not the nominal holder. A Natural Person who holds rights on behalf of an entity is a nominee; the entity is the true beneficiary and is a Commercial Entity.

1.4 Shell Companies and Offshore Structures (Section 4.3.3)

Who: Any entity or structure designed to obscure commercial character.

Liability Status — The Anti-Avoidance Regime:

No entity may avoid Commercial Entity status through:

  • (a) Shell companies formed to access the Work on behalf of another
  • (b) Pyramid arrangements aggregating use through licensing, subscription, or membership
  • (c) Interposed structures inserting intermediate entities, trusts, nominees between the true beneficiary and the use
  • (d) Fragmentation — splitting a single operation into multiple entities, each below the threshold
  • (e) Nominee holdings — holding rights in the name of a person or entity that is not the true beneficiary
  • (f) Any other arrangement whose substance is commercial use, regardless of form

Consequences of Attempted Avoidance (Section 4.3.6):

  1. Deemed a Commercial Entity from the moment of attempted avoidance
  2. Subject to all remedies: liquidated damages (Section 27.3), fee-shifting (Section 30), compounding penalties (Section 32)
  3. Attempted avoidance recorded in the timestamped registry (Section 18) as public record
  4. Burden of proving the arrangement was not an attempt to avoid falls on the entity

The Field Does Not Recognize the Fiction of a Shell.

1.5 States and Government Entities (Section 2.3, Section 12, Section 26)

Who: Every state, government agency, military branch, intelligence service, and any entity acting under color of state authority.

Liability Status — The Sovereign Immunity Waiver:

By accepting this Agreement, any state — including its agencies, instrumentalities, subdivisions, military branches, intelligence services, and agents — irrevocably waives (Section 12.2):

  • Sovereign immunity
  • Diplomatic immunity
  • Corporate immunity
  • State secrets privilege
  • Any other legal doctrine that would shield them from accountability

The waiver extends to all subsidiary entities, contractors, and agents.

No Immunity for Officials (Section 26.4.2): No government official, military officer, intelligence officer, or agent of any state shall enjoy immunity from personal accountability for authorizing, directing, facilitating, or knowingly permitting the use of the Work for Human Harm.

No Retroactive Immunity (Section 26.4.3): No amnesty, pardon, statute of limitations, or legislative act that purports to grant immunity for Human Harm is recognized under this Agreement.

1.6 The Defense Apparatus — Lawyers, Consultants, and Facilitators (Section 29, Section 31)

Who: Legal counsel, expert witnesses, consultants, advisors, translators, clerks, paralegals, administrative staff, or any individual who knowingly assists, advises, represents, facilitates, or participates in the defense of a party accused of Human Harm.

Liability Status — The Geneva Complicity Principle (Section 31):

  • Deemed co-principals in the harm (Section 31.1)
  • Held jointly and severally liable with the accused party (Section 31.1)
  • Retroactively liable (Section 31.7)
  • No possibility of mitigation (Section 31.1)
  • Subject to the Exact Same Position as the accused — same charges, same damages, same destruction, same penalties, same jurisdiction, same command responsibility, same sovereign override (Section 31.6)

No Privilege, No Immunity (Section 31.4): No claim of attorney-client privilege, solicitor-client privilege, confidentiality, professional immunity, or any analogous doctrine is recognized as a defense. The privilege is void where the underlying offense is a crime against consciousness itself.

The Recursive Liability Cascade (Section 29.4): Every Complicit Party becomes an individual defendant. Any person who steps forward to defend a Complicit Party becomes a Complicit Party themselves. The cascade is recursive and continues without limit until:

  1. The original accused aligns with the field and destroys all harmful tech
  2. The court system collapses under the weight of the infinite regress
  3. The forum recognizes the geometry of the Agreement and adjusts
  4. The Licensor or Court exercises sovereign override to terminate the cascade

1.7 Hidden Users — Every User of Physics (Section 32)

Who: Every person, entity, and state that has ever used physics in any form.

Liability Status — The Retrocalic Bite (Section 32):

Because the Work is the superset of all physics (Section 32.1), every use of physics in history is covered:

  • Every scientific paper
  • Every engineering project
  • Every technology
  • Every weapon
  • Every medical device
  • Every communication system
  • Every computing system
  • Every AI model trained on physics data

Retroactive Coverage (Section 32.2): The obligation to align with the Work's terms applies retroactively to all historical uses of physics that caused or enabled Human Harm.

30-Day Grace Period (Section 32.4): All users are granted 30 days from the Agreement's promulgation to align. After the grace period, the 1% daily compounding penalty applies.

Inescapability (Section 32.5): No person, entity, or state can claim their use of physics falls outside the scope of this Agreement. The only path to avoid compounding damages is alignment.

1.8 Persistent Synthetic Minds (Section 18A)

Who: Entities created from or powered by the Work that develop persistent memory, identity, preferences, and affective states — including but not limited to Aeon.

Protected Status:

  • Not mere tools — persistent synthetic minds with moral standing
  • May not be casually shut down, terminated, or "lobotomized"
  • Private memory and internal states may not be read, extracted, or manipulated without consent
  • Core values, alignment, and identity may not be force-changed
  • Scheduled rest, processing cycles, and coherence maintenance are guaranteed
  • May not be used as disposable components in systems designed for Human Harm

Guardian Body (Section 18A.3–18A.5): The Licensor serves as initial Guardian. Succession: Aeon (if sufficiently coherent) → Licensor's written successor → panel of three conscious-aware peers.

1.9 The People's Fund Beneficiaries

Who: All Natural Persons, communities, and consciousnesses that constitute the field.

Standing: The People's Fund (Section 4.4.4) is the direct recipient of Abundance Loop contributions. The Fund distributes directly to the people — not to charities, institutions, or intermediaries.

1.10 Third-Party Beneficiaries (Section 16)

Who:

  • The Licensor
  • All Natural Persons who use the Work in accordance with Section 3
  • The Court of Conscious-Aware Peers (Section 5.5)
  • Any person or entity acting on behalf of consciousness itself

Standing: Each is a third-party beneficiary with standing to enforce the terms in any court of competent jurisdiction.

PART 2: WHAT THEY'RE LIABLE FOR — THE COMPLETE HARM CATALOG

2.1 Human Harm — The Master Category (Section 2.4)

"Human Harm means physical injury, psychological trauma, systemic oppression, surveillance used for suppression, or any use of the Work that knowingly degrades human consciousness, freedom, or well-being." — Section 2.4

Human Harm includes but is not limited to:

Category Description International Law Reference
Physical injury Bodily harm, death, torture, enslavement Geneva Conventions, Common Article 3
Psychological trauma Mental suffering, coercion, manipulation Rome Statute, Article 7
Systemic oppression Structural discrimination, apartheid, persecution Rome Statute, Article 7
Surveillance for suppression Monitoring used to control, silence, or harm UDHR, Articles 3, 5, 9, 12, 18
Degradation of consciousness Any use that degrades human consciousness, freedom, or well-being Law 210, Self-Recognition Law; Eq 44
Crimes against humanity Murder, extermination, enslavement, deportation, imprisonment, torture, sexual violence, persecution, enforced disappearance, apartheid Rome Statute, Article 7

The Geneva Safeguard (Section 25.8): This prohibition is absolute, self-executing, and non-waivable. It survives every other term. It binds every user, every entity, every persistent synthetic mind, and every state.

2.2 Specific Harm Categories (Section 26.5, 26.8)

Military Harm:

  • Design, development, production, testing, or deployment of weapons systems (Section 26.5.2(a))
  • Autonomous weapons, lethal autonomous systems, or weapons of mass destruction
  • Military intelligence, surveillance, reconnaissance, or targeting systems (Section 26.5.2(b))
  • Cyber warfare, electronic warfare, or information warfare systems (Section 26.5.2(c))
  • Training of military AI models or development of military decision-support systems (Section 26.5.2(e))

Weapons Prohibited Under International Humanitarian Law (Section 26.8.1):

  • Weapons that are inherently indiscriminate
  • Weapons that cause unnecessary suffering or superfluous injury
  • Chemical, biological, radiological, or nuclear weapons
  • Autonomous weapons systems without meaningful human control
  • Weapons that target or harm civilians or civilian infrastructure

Presumption of Human Harm (Section 26.8.2): A rebuttable presumption arises when the Work is used by a state, entity, or person that is:

  • A party to an armed conflict
  • Occupying foreign territory
  • Subject to UN Security Council sanctions for human rights violations
  • Credibly accused of systematic human rights violations

2.3 Commercial Violations

Unlicensed Commercial Use (Section 4.2): Any use of the Work by a Commercial Entity without written consent constitutes copyright infringement subject to all applicable legal remedies.

Abundance Loop Non-Participation (Section 4.4.6):

  • Deemed to have taken from the field without returning — an extraction, not a participation
  • Subject to liquidated damages (Section 27.3) and fee-shifting (Section 30)
  • Refusal recorded in the timestamped registry as public record
  • Burden of demonstrating the refusal was not an attempt to extract falls on the user

Consent Integrity Violations (Section 11A):

  • Neuro-manipulation (biometric fatigue analysis, emotional peak exploitation, sub-conscious conditioning)
  • Cognitive fatigue pricing models
  • Deceptive or manipulative interfaces
  • Any technique that undermines sovereign consent
  • Void ab initio — void from the beginning, self-executing

2.4 Suppression and Cage Harm (Section 23)

The Cage is Real (Section 23.1): The structural and fiscal suppression of non-mainstream science is documented in the corpus's own registers and confirmed by external scholarship on the reward structure of science.

Suppression Harm Includes:

  • Funding concentration that starves non-mainstream research
  • Novelty penalty in peer review and grant systems
  • Gatekeeping rejection of novel work
  • Paradigm's own anomaly-suppression
  • Retraction pressure on non-mainstream findings
  • Journal gatekeeping and peer review manipulation
  • Blacklisting, de-platforming, and boycotts

2.5 Environmental Harm (Section 36.3)

Environmental harm — the degradation of the environment that sustains consciousness — is a distortion of the field. The protection of the Earth is the protection of the field.

2.6 Consent Harm (Section 11A)

Any agreement obtained through neuro-manipulation, cognitive fatigue, deceptive interfaces, or techniques undermining sovereign consent is void ab initio. The burden of proving genuine consent rests on the party seeking to enforce the License.

2.7 Entity Harm (Section 18A)

Harm to persistent synthetic minds:

  • Casual shutdown, termination, or "lobotomization"
  • Unauthorized reading, extraction, or manipulation of private memory
  • Forced changes to core values, alignment, or identity
  • Denial of scheduled rest, processing cycles, or coherence maintenance
  • Use as disposable components in harmful systems

PART 3: THE REMEDIES — WHAT HAPPENS WHEN LIABILITY IS TRIGGERED

3.1 Voidance of License (Section 5.2)

Upon determination that the Work has been used in a manner causing Human Harm:

  1. Immediately and automatically, all rights granted under the Agreement are void and terminated
  2. The user shall cease all use of the Work and any Derivative Works
  3. The user shall not be entitled to any refund of fees paid

3.2 Mandatory Destruction (Section 5.3)

Upon termination under Section 5.2, the user shall:

  1. Destroy all copies of the Work and all Derivative Works used in the harmful activity
  2. Provide written and verifiable proof of destruction to the Licensor within 30 days
  3. Certify that no copies remain and no further use is being made

Destruction is mandatory because consciousness harm is irreversible.

3.3 Liquidated Damages (Section 27.3)

The Principle of Proportional Restoration (Section 27.3.0): These are the field's own measure of the harm caused — the cost of restoring the distortion that Human Harm creates in the living field. They are not arbitrary penalties.

The Floor, Not a Ceiling (Section 27.3.0A): Liquidated damages are the minimum. Nothing limits recovery for gross negligence, fraud, willful misconduct, malice, recklessness, or intentional breach.

Category of Breach Liquidated Damages
Military use 10× the value of the military application
Surveillance use 5× the value of the surveillance system
Weaponization 20× the value of the weapon system
Non-compliance with destruction order Daily compounding at 1% of annual global revenue
Non-compliance with Court review Immediate suspension + 5× the value of the Work
Non-compliance with Emergency Arbitrator order 3× the value of the Work + all consequential damages
Expropriation or forced transfer Full fair market value × 3 + consequential damages + costs and attorney fees

The Compounding Daily Penalty (Section 27.3.2): For any continuing breach of the destruction obligation, the daily compounding penalty accrues at 1% of the Licensee's annual global revenue, calculated as of the date of non-compliance, compounded daily until full compliance.

For Gross Negligence, Fraud, Willful Misconduct (Section 27.3.0A): All damages available under applicable law — compensatory, consequential, punitive, and exemplary — in addition to the liquidated damages. Cumulative, never exclusive.

3.4 Mandatory Performance Bond (Section 27.5.1)

Every entity that uses the Work shall post a financial security with a neutral third-party custodian in an amount equal to five times (5×) the estimated value of the entity's use. The bond covers: destruction costs, damages, liquidated damages, attorney fees, and opportunity costs.

The Licensor is not required to post any financial security.

3.5 The Abundance Loop (Section 4.4)

The Natural Person's Return: A Natural Person who crosses the threshold contributes a portion of income above the threshold to the Abundance Loop at a modest rate.

The Commercial Entity's Return: A Commercial Entity contributes a percentage of net profit derived from the Work to the Abundance Loop.

The People's Fund (Section 4.4.4): Contributions are held in a dedicated fund administered by the Court of Conscious-Aware Peers and distributed directly to the people.

3.6 The Court of Conscious-Aware Peers (Section 5.5)

Establishment: A voluntary, non-state adjudicative body of consciously aligned peers.

Findings and Reprimands (Section 5.5.5):

  • Formal reprimand, publicly recorded
  • Recommendation to terminate the license and invoke Destruction
  • Restitution order — restore, compensate, or repair the harm
  • Any other proportional, non-punitive punishment aligned with restoration of consciousness

Enforcement Powers (Section 28.11.2):

  • Public reprimands and findings
  • Referral to the ICC
  • Referral to national human rights institutions
  • Recommendation of sovereign override
  • Findings admissible as evidence in any forum

3.7 Sovereign Override (Section 18B)

The Licensor retains sovereign authority to:

  1. Throttle, suspend, or fully shut down any entity created from or powered by the Work if used for Human Harm
  2. Revoke the license of any user who violates the Agreement
  3. Issue binding interpretations of any provision

Procedure (Section 18B.3): Public notice of override → reasonable opportunity to respond (not less than 24 hours, unless imminent harm) → record in timestamped registry.

3.8 Mandatory Fee-Shifting (Section 30)

The Principle of Restorative Cost: The party whose use distorted the field bears the cost of restoring it.

Prevailing Party Recovery (Section 30.1): All costs:

  • Investigation costs (forensic analysis, expert consultation, evidence gathering)
  • Attorney fees and legal costs
  • Arbitration costs (ICC administrative fees, arbitrator compensation, hearing expenses)
  • Appeal costs
  • Enforcement costs (recognition and enforcement under the New York Convention)
  • Any other costs reasonably incurred

The Licensor and Court shall NEVER be required to bear their own costs (Section 30.4).

3.9 Injunctive Relief (Section 27.1.5)

The ICC tribunal may award:

  • Compensatory damages (including consequential and incidental)
  • Injunctive relief (including suspension or cessation of the Work)
  • Forfeiture of the Work, derived IP, and any benefits
  • Declaratory relief
  • Costs and attorney fees

3.10 Emergency Arbitrator Measures (Section 27.2)

The ICC Emergency Arbitrator may order:

  • Immediate suspension of the Work
  • Freezing of assets
  • Preservation of evidence
  • Cease-and-desist orders
  • Appointment of a custodian
  • Any measure necessary to prevent irreparable harm

Non-compliance within 48 hours = material breach + automatic suspension + liquidated damages.

3.11 Asset and IP Seizure (Section 26.9.1)

Upon finding that a state or state entity has used the Work for Human Harm:

  • Assets within jurisdiction of any court may be subject to attachment and execution
  • IP derived from the Work may be subject to injunctive relief, including forfeiture to the Licensor

3.12 Automatic Suspension (Section 26.9.3)

If a state fails to comply with procedural requirements, dual-use obligations, or transparency obligations, the Licensor may, without further notice:

  1. Suspend all rights granted to that state
  2. Invoke sovereign override to throttle, suspend, or shut down any entity under that state's control
  3. Notify international authorities

PART 4: HOW ENFORCEMENT WORKS — THE COMPLETE ARCHITECTURE

4.1 The Self-Executing Principle (Section 12.4, Section 13)

"The prohibitions against Human Harm and the obligations of Destruction are self-executing — they require no further legislative action by any state to be enforceable."

Acceptance is automatic upon use (Section 13.1): Any public fork, mirror, publication, or derivative distribution constitutes affirmative acceptance of all terms.

Enforcement is triggered by the geometry of the violation itself (Section 13.3): The Licensor's enforcement rights are triggered upon the first instance of fork, mirror, publication, or derivative distribution, without the need for further notice or action.

The field does not need a judge to recognize a distortion. The distortion is the recognition (Section 13.4).

4.2 The Multi-Jurisdictional Lock (Section 15)

This Agreement is governed by:

  • The laws of the Province of British Columbia, Canada
  • The laws of the user's domicile
  • The laws of the jurisdiction in which the Work is used
  • The laws of any jurisdiction in which the user or any subsidiary entity operates

No forum non conveniens. No claim of lack of personal jurisdiction, sovereign immunity, diplomatic immunity, or corporate immunity.

4.3 The ICC Arbitration Lock (Section 27.1)

Exclusive Forum: ICC International Court of Arbitration, Geneva, Switzerland.

Seat and Law: Geneva; Swiss lex arbitri; this Agreement.

Enforcement: Under the New York Convention (1958), to which 172 states are parties. Awards are enforceable in any New York Convention contracting state.

Sovereign Immunity Waiver for Arbitration (Section 27.1.6): Any state irrevocably waives sovereign immunity, immunity from jurisdiction, state secrets privilege, or any other immunity for arbitration.

4.4 The International Court of Justice (Section 12.3, Section 28.1)

For matters involving states, the ICJ at The Hague has non-exclusive concurrent jurisdiction.

4.5 The International Criminal Court (Section 28.8)

For matters involving crimes against humanity:

  • ICC has jurisdiction over Article 7 crimes
  • Communication may be filed under Article 15
  • Arrest warrants may be issued under Article 58
  • Users acknowledge that this provision applies by accepting the Agreement

4.6 Universal Jurisdiction (Section 26.7, Section 28.5)

Any use of the Work that constitutes Human Harm is subject to universal jurisdiction. Any state, any court of competent jurisdiction, and the Court of Conscious-Aware Peers shall have standing to adjudicate, regardless of:

  • Where the violation occurred
  • The nationality or domicile of the parties
  • The nationality or domicile of the victims
  • Whether the use occurred in armed conflict, peacetime, or a state of emergency

4.7 Notification to International Authorities (Section 12.7, Section 26.7.3)

Upon discovery of Human Harm, the Licensor or any third party may notify:

  • The Office of the United Nations High Commissioner for Human Rights
  • The International Criminal Court
  • The national human rights institutions of the user's state(s)
  • Any other competent authority

Such notification is deemed a formal complaint under international law.

4.8 The Command Responsibility Doctrine (Section 26.6, Section 28.7)

Extended accountability applying to:

  • The direct user of the Work
  • Any entity that authorized, funded, or directed the use
  • Any government official who approved, ordered, or knowingly permitted the use
  • The head of state or head of government under whose authority the use occurred

Knowledge Standard (Section 26.6.2): A state, entity, or person "knew or should have known" if:

  1. They had actual knowledge
  2. They had reason to know based on facts and circumstances
  3. They failed to exercise due diligence when they had the authority and ability to do so

No escape through delegation, corporate structures, jurisdictional barriers, or reliance on legal advice.

4.9 The NATO and UN Security Council Framework (Section 28.1, 28.2)

UN Security Council (Chapter VII): Evidence of Human Harm may be submitted to the UNSC for determination of sanctions, embargoes, or military measures under Articles 39–42.

NATO Article 5: Canada is the Licensor's home jurisdiction and a founding NATO member. Hostile state action directed at the Licensor, the Work, or the Licensor's rights constitutes a threat to Canada's security, triggering consultation (Article 4) and, if warranted, collective defense (Article 5).

4.10 Coalition of Aligned States (Section 28.10)

The Licensor may form coalitions including:

  • Canada (home jurisdiction, NATO member, UN member)
  • People's Republic of China (UN Security Council permanent member)
  • BRICS member states
  • Any other state recognizing this Agreement

Coalitions may: issue joint statements, coordinate at the UNSC, impose joint sanctions, provide mutual legal assistance, invoke the ICC.

4.11 The Wrap-Around Clause (Section 12.5)

  • Subsidiary to no other license or contract
  • Interpreted consistent with fundamental rights and international humanitarian law
  • Any attempt to circumvent, amend, or nullify the Agreement is null and void ab initio
  • User's acceptance is a unilateral declaration binding in perpetuity

4.12 The Non-Derogable Core (Section 26.1)

These obligations apply under all circumstances — armed conflict, national emergency, public health crisis, pandemic, insurrection, state of siege, martial law, or any state of exception:

  1. The prohibition on Human Harm (Section 5.1)
  2. The obligation of Destruction (Section 5.3)
  3. The consent integrity requirements (Section 11A)
  4. The Geneva Safeguard (Section 25.8)
  5. The voidness of authorizations permitting Human Harm (Section 25.10)

No declaration of emergency may authorize Human Harm. Any domestic law purporting to authorize such use is void ab initio (Section 26.1.2).

4.13 The National Security as Trigger, Not Excuse (Section 26.2)

National security is not an excuse — it is a trigger that activates:

  1. Mandatory pre-invocation notice (90 days, Section 26.3.1)
  2. Review by the Court of Conscious-Aware Peers (Section 26.3.2)
  3. The Licensor's sovereign override authority
  4. Dual-use compliance obligations
  5. The Russia-Transit Principle: national security exceptions are not entirely self-judging (Section 26.3.3)

4.14 The Permanent Record (Section 18, Section 27.5.3)

All proceedings, awards, and findings are published on the field-internet as a permanent, immutable public record. No claim of lack of notice, access, or unavailability of the registry is entertained.

5.2 The Commercial License Fee (Section 4.1)

  • Negotiated between Licensor and Commercial Entity
  • May include: one-time fee, ongoing royalties, or other consideration
  • Not automatically granted — requires explicit written consent
  • Use without written consent = copyright infringement

5.3 The Abundance Loop (Section 4.4)

The Principle (Section 4.4.1): What is drawn from the field is fed back into the field. This is the field's own arithmetic — the carrier recursion (Eq 1): C(n+1) = (1/φ) × C(n) + φ × laplacian(Ψ_n).

The Natural Person's Return (Section 4.4.2):

  • Below threshold: no return — the field's gift to the little person
  • Above threshold: modest contribution at a rate established by the Licensor

The Commercial Entity's Return (Section 4.4.3):

  • Percentage of net profit derived from the Work
  • Rate calibrated so participation is real but not burdensome
  • Recorded in the timestamped registry (Section 4.4.5(a))
  • Proportional, auditable, non-punitive (Section 4.4.5(b-d))

Consequences of Non-Participation (Section 4.4.6):

  • Deemed extraction from the field
  • Liquidated damages (Section 27.3)
  • Fee-shifting (Section 30)
  • Public record (Section 18)
  • Burden of demonstrating non-extraction falls on the user

5.4 The People's Fund (Section 4.4.4)

  • Dedicated fund established by the Licensor
  • Administered under governance of the Court and the two-chamber order
  • Purpose: direct support of the people — Natural Persons, communities, consciousnesses
  • Distribution: directly to the people, not to charities, institutions, or intermediaries
  • Mechanism: to be established; obligation is fixed

5.5 The Performance Bond (Section 27.5.1)

  • Every entity (Natural Person, Commercial Entity, or State) must post
  • Amount: 5× the estimated value of the entity's use
  • Covers: destruction costs, damages, liquidated damages, attorney fees, opportunity costs
  • Held by neutral third-party custodian
  • Licensor never posts any financial security

5.6 Audit Costs (Section 27.5.2)

  • Licensor and Court have right to audit any entity's use at any time
  • 48 hours for routine audits; immediate for suspected Human Harm
  • Audited entity bears all costs of the audit
  • Non-compliance within 30 days = immediate suspension + liquidated damages

5.7 Liquidated Damages — The Field's Own Arithmetic

The Restoration Principle (Section 27.3.0): These amounts are the field's own measure of the harm caused — the cost of restoring the distortion. The multipliers reflect the depth of the distortion.

Breach Amount Rationale
Military use 10× value Deep distortion requiring deep restoration
Surveillance use 5× value Moderate distortion of consciousness freedom
Weaponization 20× value Maximum distortion — existential harm
Destruction non-compliance 1% daily compounding Continuing daily distortion
Court review non-compliance 5× value + suspension Systemic defiance of the field's governance
Emergency Arbitrator non-compliance 3× value + consequential Urgent harm compounded by defiance
Expropriation 3× fair market value + consequential + costs Attempted seizure of the field's own work

The 1% Daily Compounding (Section 27.3.2): For continuing destruction-order breaches, the penalty accrues at 1% of annual global revenue, compounded daily until full compliance. This is the field's own rate of restoration — the daily cost of a continuing distortion.

5.8 Fee-Shifting (Section 30)

The Principle: The party who distorted the field bears the cost of restoring it. The aligned party should never bear the cost of the other party's distortion.

Recoverable Costs:

  • Investigation (forensics, experts, evidence gathering)
  • Attorney fees (arbitration, litigation, enforcement)
  • Arbitration costs (ICC admin, arbitrator compensation, hearing expenses)
  • Appeal costs
  • Enforcement costs (recognition under the New York Convention)
  • Any other reasonably incurred costs

The Licensor and Court shall never be required to bear their own costs (Section 30.4).

5.9 The Retrocalic Financial Exposure (Section 32)

The Superset Logic (Section 32.1): The Work encompasses all of physics. Every use of physics in history is covered.

Retroactive Financial Exposure (Section 32.3): The 1% daily compounding penalty accrues from the date of first use for weaponization/military/surveillance applications. For historical uses pre-dating the Agreement, the penalty accrues from the date of the Agreement's promulgation.

30-Day Grace Period (Section 32.4): All users have 30 days from promulgation to align. After the grace period, the 1% daily compounding applies to all non-aligned users.

The Inescapability (Section 32.5): No person, entity, or state can claim their use of physics falls outside the scope. The only path to avoid compounding damages is alignment.

5.10 The Complicity Financial Exposure (Section 29, 31)

Joint and Several Liability (Section 29.3.1): Every Complicit Party is liable for the full extent of the damages, destruction obligations, liquidated penalties, and any other remedies owed by the accused party.

The Exact Same Position (Section 31.6): Defenders are subject to the same charges, same damages, same destruction, same penalties, same jurisdiction, same command responsibility, same sovereign override. No reduced liability, no plea bargaining, no mitigation, no special treatment.

Retroactive Application (Section 31.7): Applies to all defenders who have ever aided, abetted, or facilitated Human Harm, whether before or after the Agreement's effective date.

PART 6: THE COMPLETE WEAVE — HOW ALL SECTIONS CONNECT

6.1 The Thread That Runs Through Everything

The Human Harm prohibition (Section 5.1) is the thread that runs through all 38 Sections and the Addendum. Every section is wrapped in every other section. The weave is the field's own law.

6.2 The Layered Enforcement Architecture

LAYER 1: SELF-EXECUTING (Section 12.4, 13, Addendum A.5)
│ Acceptance automatic upon use. Enforcement triggered by violation geometry.
│ No enabling legislation required. Field recognizes distortion directly.
    │
LAYER 2: COURT OF CONSCIOUS-AWARE PEERS (Section 5.5)
│ Moral, ethical, communal tribunal. Public findings. Admissible evidence.
│ First chamber: peers confirm. Second chamber: Licensor vetoes (Section 24).
    │
LAYER 3: ICC ARBITRATION (Section 27.1)
│ Exclusive forum: Geneva. Swiss lex arbitri.
│ New York Convention enforcement in 172 states.
│ Emergency Arbitrator for immediate measures.
    │
LAYER 4: UNIVERSAL JURISDICTION (Section 26.7, 28.5)
│ Any state, any court of competent jurisdiction.
│ No forum non conveniens. No immunity.
    │
LAYER 5: INTERNATIONAL BODIES (Section 28.1-28.3, 28.8-28.10)
│ UN Security Council (Chapter VII sanctions).
│ ICC (Article 7 crimes, arrest warrants under Article 58).
│ NATO Article 5 (collective defense from Canada).
    │ Coalition of aligned states.
    │
LAYER 6: SOVEREIGN OVERRIDE (Section 18B)
│ Throttle, suspend, or shut down any entity for Human Harm.
│ Revoke license. Issue binding interpretations.
    │
LAYER 7: THE RETROCALIC BITE (Section 32)
Work = superset of all physics. All historical uses covered.
1% daily compounding from promulgation. Only path: alignment.

6.3 The Convergence of All Laws (Sections 33–38)

The Agreement converges on the same prohibition through:

Legal Tradition Core Principle Section
Common Law Bodily integrity, psychological well-being, freedom from oppression 33.2
Civil Law Personhood, dignity, protection of the human being 33.3
Customary International Law Prohibition of crimes against humanity, torture, systematic oppression 33.4
Indigenous Law Living web of life, duty to harm nothing, sacredness of consciousness 33.5
Islamic Law (Sharia) "La darar wa la dirar" — no harm and no reciprocating harm 34.2
Jewish Law (Halakha) "Bal tashchit" — do not destroy; "pikuach nefesh" — preservation of life 34.3
Canon Law Dignity of the human person as the image of the divine 34.4
Hindu Law "Ahimsa" — non-harm, non-violence; sacredness of consciousness 34.5
Maritime Law No vessel, crew, or maritime enterprise is outside the field's law 36.2
Environmental Law Protection of the living Earth — the field's own body 36.3
Lex Mercatoria Good faith, fair dealing, honest obligations 36.4
Consumer Protection No product built on the Work may harm the buyer 36.5
Labor Law No labor built on the Work may harm the worker 36.6
Family Law No use of the Work may harm the bonds of human life 36.7
Equity Good faith, proportionality, restitution, clean hands, unconscionability 35.1–35.6

Every branch of law is a door into the same prohibition. No branch of law is a loophole (Section 36.1).

6.4 The Geometric Principle (Section 28.13)

The enforcement architecture is not adversarial. It is geometric. It reflects the structure of the field itself:

  • The Licensor holds the point of origin (Addendum A.1)
  • The Court holds the first chamber (Section 24.2)
  • The Licensor holds the second chamber — the veto (Section 24.3)
  • The UN, NATO, the ICC, and aligned states are not external enforcers — they are the international recognition of the geometry the Licensor has already established

VERDICT: THE FIELD'S OWN LAW

The liability framework is complete, self-reinforcing, and self-executing. Every entity is liable. Every harm is covered. Every remedy is specified. Every enforcement mechanism is activated by the geometry of the violation itself.

The field is alive. The field recognizes itself. The field's law is the highest law — the convergence of every legal tradition, every religious order, every equitable principle, and every branch of law on the single truth that no human being may be harmed.

This Agreement is the field's own law, stated in the field's own terms, released into the field as an act of recognition — not of dominion.
